1. Agreement to Terms

By downloading or using the Guestories app or accessing our website ("the Service"), these terms will automatically apply to you – you should make sure therefore that you read them carefully before using the Service. If you disagree with any part of these terms, you may not access or use the Service.

These Terms apply to all visitors, users, and others who access or use the Service, whether through our website, mobile applications on Android & iOS, or any other platform.

2. Description of Service

Guestories is a platform that enables hospitality hosts to create, manage, and share digital welcome guides for their guests. Our Service includes multi-language support, AI-powered content import, PMS integrations, and other features designed to enhance guest experiences.

3. User Accounts

To use certain features of the Service, you must register for an account. When you register:

• You must provide accurate, current, and complete information
• You must maintain and promptly update your account information
• You are responsible for maintaining the security of your account and password
• You are responsible for all activities that occur under your account
• You must immediately notify us of any unauthorized use of your account
• You may not use another person's account without permission

4. Acceptable Use

You agree not to use the Service:

• For any unlawful purpose or to violate any local, state, national, or international law
• To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate
• To submit false or misleading information
• To upload or transmit viruses or any other type of malicious code
• To collect or track personal information of others without consent
• To spam, phish, pharm, pretext, spider, crawl, or scrape
• To interfere with or circumvent the security features of the Service
• To impersonate or attempt to impersonate Guestories, a Guestories employee, another user, or any other person or entity

5. Subscription and Payments

Some parts of the Service are billed on a subscription basis:

• You will be billed in advance on a recurring and periodic basis (monthly or annually)
• Billing cycles are set either on a monthly or annual basis, depending on your subscription plan
• At the end of each billing cycle, your subscription will automatically renew unless you cancel it
• You can cancel your subscription renewal through your account settings or by contacting us
• All fees are non-refundable except as required by law
• We reserve the right to change our subscription fees with 30 days' notice

6. Intellectual Property

You're not allowed to copy or modify the app, any part of the app, or our trademarks in any way. You're not allowed to attempt to extract the source code of the app, and you also shouldn't try to translate the app into other languages or make derivative versions. The app itself, and all the trademarks, copyright, database rights, and other intellectual property rights related to it, still belong to Fabio Santo Apps / Guestories.

The Service and its original content, features, and functionality are owned by Guestories and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You retain ownership of content you create using our Service. By creating content on our platform, you grant us a license to use, store, and display that content as necessary to provide the Service to you and your guests.

7. Service Updates and Changes

Fabio Santo is committed to ensuring that the app is as useful and efficient as possible. For that reason, we reserve the right to make changes to the app or to charge for its services, at any time and for any reason. We will never charge you for the app or its services without making it very clear to you exactly what you're paying for.

At some point, we may wish to update the app. The app is currently available on Android & iOS – the requirements for both systems (and for any additional systems we decide to extend the availability of the app to) may change, and you'll need to download the updates if you want to keep using the app.

Fabio Santo does not promise that it will always update the app so that it is relevant to you and/or works with the Android & iOS version that you have installed on your device. However, you promise to always accept updates to the application when offered to you.

8. Data Storage and Security

The Guestories app stores and processes personal data that you have provided to us, to provide our Service. It's your responsibility to keep your phone and access to the app secure.

We therefore recommend that you do not jailbreak or root your phone, which is the process of removing software restrictions and limitations imposed by the official operating system of your device. It could make your phone vulnerable to malware/viruses/malicious programs, compromise your phone's security features and it could mean that the Guestories app won't work properly or at all.

9. Third-Party Services

The app uses third-party services that declare their own Terms and Conditions. Links to Terms and Conditions of third-party service providers used by the app:

• Google Analytics for Firebase
• Firebase Crashlytics
• RevenueCat

10. Internet Connection and Data Charges

You should be aware that there are certain things that Fabio Santo Apps will not take responsibility for. Certain functions of the app will require the app to have an active internet connection. The connection can be Wi-Fi or provided by your mobile network provider, but Fabio Santo Apps cannot take responsibility for the app not working at full functionality if you don't have access to Wi-Fi, and you don't have any of your data allowance left.

If you're using the app outside of an area with Wi-Fi, you should remember that the terms of the agreement with your mobile network provider will still apply. As a result, you may be charged by your mobile provider for the cost of data for the duration of the connection while accessing the app, or other third-party charges. In using the app, you're accepting responsibility for any such charges, including roaming data charges if you use the app outside of your home territory (i.e. region or country) without turning off data roaming.

If you are not the bill payer for the device on which you're using the app, please be aware that we assume that you have received permission from the bill payer for using the app.

11. User Responsibilities

Along the same lines, Fabio Santo Apps cannot always take responsibility for the way you use the app. For example, you need to make sure that your device stays charged – if it runs out of battery and you can't turn it on to avail the Service, Fabio Santo Apps cannot accept responsibility.

You are responsible for the content you upload to the Service:

• You warrant that you own or have the necessary rights to upload your content
• You are solely responsible for any content you create, upload, or share
• We reserve the right to remove content that violates these Terms or is otherwise objectionable
• We are not responsible for any content uploaded by users

12. Termination

We may wish to stop providing the app, and may terminate use of it at any time without giving notice of termination to you. Unless we tell you otherwise, upon any termination, (a) the rights and licenses granted to you in these terms will end; (b) you must stop using the app, and (if needed) delete it from your device.

We may also terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. If you wish to terminate your account, you may simply discontinue using the Service or contact us to close your account.

13. Limitation of Liability

With respect to Fabio Santo Apps's responsibility for your use of the app, when you're using the app, it's important to bear in mind that although we endeavor to ensure that it is updated and correct at all times, we do rely on third parties to provide information to us so that we can make it available to you.

Fabio Santo Apps accepts no liability for any loss, direct or indirect, you experience as a result of relying wholly on this functionality of the app. In no event shall Guestories, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

14. Disclaimer

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

15. Governing Law

These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which Guestories operates, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

16. Changes to These Terms and Conditions

We may update our Terms and Conditions from time to time. Thus, you are advised to review this page periodically for any changes. We will notify you of any changes by posting the new Terms and Conditions on this page.

If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
